There are two agencies where we must focus our communications: The New Castle County Land Use Department and the State Department of Transportation. Now it is time for us to speak directly to the State Department of Transportation.
Our efforts are important, but your strong support is much more powerful. Contact your state and
county elected officials and insist that they make every effort to support our efforts.
Citizens for Responsible Growth in New Castle County has been established as an organization to address these issues. A fund is being developed to hire a traffic engineer, land planning expert, land use litigation attorney, and communications specialist. With accurate traffic data, sensitive land use planning, and legal assistance the community can help bring about responsible growth that enhances--not destroys--our county. Please visit their web site and donate!
Oct 6 - The Stoltz organization’s legal counsel has withdrawn its request to appear before the New Castle
County Planning Board and Land Use Department on October 7 at 7 PM for the purpose of seeking a positive
recommendation that deed restrictions be amended to permit an additional building to be constructed at
the old Columbia Gas site, 20 Montchanin Road. Accordingly, there is no need to come to the meeting.
It is anticipated that Stoltz may again proceed forward at some time in the future. We are only as
safe as we remain vigilant.
On Friday October 3, the KPA sent a letter to
Acting Land Use Department G.M. George Haggerty and County Attorney Gregg Wilson, with supporting
Affidavits from Allen Terrell, former Chief Justice E. Norman Veasey and Rodman Ward, Jr,
explained why the deed restriction amendment application could not proceed for further
consideration by New Castle County unless and until it has the consent and approval of The Hagley
Foundation and The Kennett Pike Association. Bob Weiner then requested that the application be removed
from the Planning Board/Land Use Department October 7 agenda. Stoltz has voluntarily consented to a
tabling of its hearing at this time.
The KPA and the Council of Civic Organizations of Brandywine Hundred (CCOBH)
have sent letters to our officials:
Gov.
Minner, Sec.
Wicks, NCCo
Ex. Coons, and NCCo
Council President Clark. Here is a link to a Community
News article on the subject.
Rep. Bob Weiner's web site also has many current documents on the subject.
You can visit the Stoltz website and look at each proposal. Click 'Portfolio' on the home page, and then click 'NCC Developments' on the next page. You will then see a clickable list of the projects.
The State Department of Transportation is currently formulating its method of analysis and our input can make a difference. Review again DELDOT's 5/29/08 scoping letter and then read Chris McEvilly's concise and focused testimony before the County Planning Board and Land Use Department, appended below. Comments can be directed to Troy Brestel, DELDOT Project Engineer, who has been assigned to this application with copies to Secretary of Transportation Carol Ann Wicks, DELDOT Planning Manager Ralph Reeb, DELDOT Assistant Planning Manager Ted Bishop, Senator Charlie Copeland, Representative Gerald Brady and to Bob Weiner.
